Terms of Use

Version 3 · effective from Oct 21, 2026 · 7cb609f8

1. ACCEPTANCE By booking a Viva Nature experience, you accept these terms. The version in force at the time of your booking is recorded alongside it, with the date and moment of acceptance. That version is the one that applies to your purchase, even if this text changes later. 2. THE SERVICE Viva Nature is an inbound tourism agency in Florianópolis, Santa Catarina, Brazil. We sell tours and experiences as a tourism service, either our own or operated by partners. We are a tourism service provider registered with Cadastur, and the registration number is published in the site footer. What each tour includes, the meeting point, the check-in time and the participation conditions are those stated on the experience page and on your booking receipt. 3. BOOKING AND SEAT HOLD When you start checkout, the seat is held in your name for the period shown on screen. After you submit your details, the seat stays held until the day and time shown on the booking page. That period is at most one day, and it may be shorter when the departure is close to closing for bookings. If payment is not confirmed within that period, the hold ends and the seat returns to inventory automatically. A booking is only confirmed after the Viva Nature team confirms receipt of the payment. You receive the confirmation by email. 4. PAYMENT Payment is not made on the site. After you submit your details, the booking awaits payment, and you complete it over Viva Nature's WhatsApp. There, the payment method is agreed with you: Pix, card or cash. No card details are entered on the site or pass through our system. When the payment arrives, the team confirms receipt. When an amount is returned, it is returned through the same method agreed with the team for the payment. 5. CANCELLATION AND REFUND You can cancel your booking through the site as long as it has not been used. The refunded amount is calculated along two axes: the time elapsed since purchase and the time remaining until departure. Both are calculated, and the one that refunds more is the one that applies to you. The rule that applies is the one published on the experience page at the moment you purchased. It is frozen into your booking: a policy change after the purchase does not change what you already contracted. The ladder of deadlines and amounts lives on each experience page, not here. The same rule written in two places eventually diverges, and the tour page is where it is decided. The applicable cancellation and refund policy is the one published on the experience page at the time of purchase. Within the first days after purchase, the refund is full, under the right of withdrawal provided by the Brazilian Consumer Protection Code. The exact deadline is on the experience page. 6. NO-SHOW AND RESCHEDULING If you do not show up at the meeting point at the agreed time, the booking is handled along the time-to-departure axis, in the band corresponding to the moment of departure. There is no additional charge for not showing up. Rescheduling depends on seat availability on another departure of the same experience. Request it through the contact channels stated in your booking, and the sooner the better. 7. OPERATIONAL CANCELLATION Sea, weather or safety conditions may force us to cancel a departure. In that case the cancellation is operational and the refund is full, with no band discount at all. When an alternative departure exists, rescheduling is offered as an option, and the choice is yours. The decision to cancel for safety reasons belongs to the team and to the activity leader, and it is always made in favour of your safety. 8. RISK AND RESPONSIBILITY The experiences take place in a natural environment and involve risk that cannot be entirely eliminated. That is why a Risk Acknowledgement Statement exists, with its own acceptance, which you read and accept before completing the purchase. You undertake to follow the instructions of the team and of the guides throughout the activity. Before departure, report any relevant health condition, pregnancy, mobility restriction or medication use that may affect your participation. The team may prevent or interrupt the participation of anyone who is not in a condition to do the activity safely, or who is under the effect of alcohol or another substance. Minors take part accompanied by a responsible adult, who answers for them. 9. ACCOUNT To follow your bookings you may create an account with an email address and a password. The email is verified before first access. The password is personal: keep it confidential and tell Viva Nature if you suspect improper access. You may request the closure of your account at any time, through the site's contact channels; bookings and acceptances already recorded remain stored for as long as the law requires. 10. INTELLECTUAL PROPERTY The Viva Nature brand, the logo, the texts, the photographs and the illustrations on this site are ours or used with authorisation. You may share page links freely. Copying the content for commercial use requires written authorisation. 11. AVAILABILITY We do our best to keep the site online, but it may become unavailable due to maintenance or technical failure. Site unavailability does not cancel an already confirmed booking: your booking remains valid and the departure goes ahead normally. 12. CHANGES These terms may change. Each change is published as a new version, with its own effective date. The version in force is always the one displayed on this page. What you accepted is recorded alongside your booking, and that is the version that applies to it. 13. GOVERNING LAW These terms are governed by Brazilian law. The courts of the district of Florianópolis, Santa Catarina, Brazil, are elected for matters not resolved otherwise. Starting text, subject to legal review before launch.

Risk Acknowledgement Statement

Version 1 · effective from Jan 1, 2026 · 26153979

The experiences offered by Viva Nature take place in a natural environment — sea, trail and uneven terrain — and involve risks that cannot be entirely eliminated, among them sea and weather conditions, boat movement, falls, slips, sunstroke, dehydration and contact with local wildlife and vegetation. By accepting this statement, you declare that you are aware of those risks, that you have reported any relevant health conditions and that you undertake to follow all instructions from the team and from the guides during the activity. Pregnant people and people with heart, spine or reduced mobility conditions must consult Viva Nature before booking. Minors take part only when accompanied by a responsible adult. The team may interrupt or cancel the activity at any time for safety reasons. Starting text, subject to legal review before launch.

The cancellation rule for each tour, with deadlines and percentages, is on the tour page. See all experiences
